Former English Tutor Sentenced for Sexually Exploiting Children in China and US

Hector Orjuela Jnr., aged 47, was sentenced to 30 years in prison, followed by a lifetime of supervised release, for molesting children under the age of 12 and producing child pornography, announced the US Department of Justice.

Orjuela Jnr., a US citizen, had been working as an English tutor in Shanghai before he was extradited to the US in December 2012 to face charges of illicit sexual conduct in foreign places. He pleaded guilty to all charges.

According to court documents, Orjuela had been working as en English teacher and tutor in Shanghai. In July 2012 he traveled to Maryland and molested a girl under the age of 12 and produced child pornography of the abuse. In August 2012, he returned to China and molested a girl under the age 12 and tried to molest another. He returned to America in November 2012 and then returned to China later that month and continued molesting those same two girls. He was eventually caught by the two young girls’ expatriate mother, who informed police.

No, I am saying the argument of those who are devising curriculum from the Social Efficiency ideology is based on scientific instrumentalism. A child's behavior is to be changed or shaped according to what society needs and the growth and development of the child is not an issue. It is a value neutral position that compartmentalizes education. The originator of this trend in curriculum, Bobbitt in 1913, says "Education is a shaping process as much as the manufacture of steel rails; the personality is to be shaped and fashioned into desirable forms." Therefore, the child's needs and personal development are incidental to this process. The goal is to be able to measure test results scientifically; anything else is incidental and is ignored. It is hard to measure the effect of a teacher's obsession with sex in class discussions, so that phenomenon can be compartmentalized as having no effect on children, as JayKnox above has asserted. That teacher's behavior can be compartmentalized, separated and treated as incidental - from the point of view of a social efficiency educator. Do you hear echoes of B. F. Skinner here? He is the psychologist of choice for this ideology. It is a very narrowly focused approach: as long as those steel rails are going out the factory doors according to specs, then that teacher is performing his task as specified in the accountability structure of the schools. His attitudes and values don't exist or are irrelevant and their effects if any, cannot be measured scientifically. The civilizing effects of art, drama, debate, music, and library budgets are being stripped from the schools; only the rich can have those frills. This is the direction schools have been going for the past 30 years, and we will reap what has been sown. Principals are no longer educational leaders, but managers of million dollar budgets like Walmart executives. A person like Mr. Davis is tolerated because he gets the results the school wants and his personal agenda is ignored until he goes too far. Then he is quietly asked to leave. The next move is up to that school in Suzhou.

Dr. Michael Davis is not listed on the staff of ULink school in Suzhou. There is a vacancy for (1) history and (2) English teachers for that staff. Jay Knox is right that the discussion of the main article does not involve college students. However, teachers who are members of a professional association are held accountable within the general directives for the code of behavior they have agreed to follow. Nevertheless as JayKnox has pointed out what a teacher or tutor does in his private life can be separated from the results he is expected to achieve in the work situation, and that argument is supported by the "Social Efficiency Ideology" which has prevailed in educational environments in developed countries for the last 30 years. This ideology has its roots in four movements: social reform, utilitarian education, behavioral psychology, and scientific methodology. Scientific instrumentalism is concerned with the ends and means which serve the needs of society based on the ethically neutral concept of efficiency as a criteria for judging them. As a reslt, there is no criterion of value for judging "good" or "bad", "just" or "unjust","sane" or "insane" ends for the curriculum.Neither is there a criterion of value for judging "kind" or "unkind", "moral" or "immoral", or "responsible" or "irresponsible" means of creating the curriculum. Bobbitt (the man who used the analogy of producing rails in a steel mill) points out the pervasiveness of this system of instrumental values when he writes that "any instrument or experience which is effective ...is the right instrument and right experience; and ...anything that is not effective is wrong" (1918). So a clever lawyer could have argued that Dr. Davis' methods coincide with a society that uses sexuality to sell almost any product on billboards or prime time TV, so as long as he gets the results his job requires what he does has been effective. Psychologists and others who have worked with adults who experienced incest or early sexual initiation conclude that one such incident is sufficient to set off long-term disturbances through adulthood. Most sex addicts have a history of such initiations. Read some of the writings of Sylvia Plath and Anais Nin; didn't both of these women commit suicide? But they did learn to write and that is a separate issue as you have pointed out. Someone who espouses the "Learner Centered Ideology" and is concerned with the growth and development of impressionable young people might disagree strongly with the distinction you made. The acts of the student (tasks fulfilled) are what really count, and the person acting (individual & his or her values) is really secondary. Evidently, Dr. Davis was effective at producing good workers who will meet and fit the needs of society so he should be allowed to continue in this role.

I'd like to respond to comments #11 primarily and #12 as well. I agree with some of the calls that #12 made about being set up by disgruntled students. I saw a teacher immediately suspended by a superintendent because of a 16 year old girl's complaint about sexual harassment at 3 p.m. on a ground level classroom with hundreds of students passing by the doorway! She later admitted she was hitting back at him for a low grade on an assignment. The teacher was reinstated - no blame attached but was warned not to interview females alone in a classroom without a witness. Getting back to the case of Dr. Michael Ray Davis, if this is the man employed in Suzhou. The repeated use of sexualized language and sexual references falls significantly short of the behavior expected of a teacher. for these reasons I support the panel's recommendation that a prohibition order is imposed ...and that he be given a review period of five years. this means that Dr. Michael Ray Davis is prohibited from teaching indefinitely and cannot teach in any school, Sixth form College, relevant youth accommodation or children's home in England. He may apply for the Prohibition Order to be set aside, [bold black] but not until 5 years from the date of this order at the earliest. Without a successful application, Dr. Michael Davis remains barred from teaching indefinitely. This order takes effect from the date on which it is served on the Teacher. July 2, 2012 My note from the leading page: Mr. Davis did not attend the hearing and was not represented. One piece of evidence entered was the mnemonic, SEX, used to assist in a writing lesson: S = source, E = evidence or example, X = explanation . It is ironic that Dr. Davis was not present at this hearing to give his "explanation" of his practices. Did this school in Suzhou do its "due diligence" to conduct an adequate reference check on this man? On the other hand, these "storefront for-profit education businesses" are desperate for native speakers and may choose to disregard an individual's past record.

There are many people here in China, Thailand, and other countries in Southeast Asia who are teaching English but they are not trained teachers. "Instructor or tutor" would be a better description of their status. Some of these instructors are quite close in age to the college students they teach, and they see nothing wrong in exploiting the teacher/student relationship for their own needs. There is no "crossing of a line" as far as this kind of individual is concerned; they are on vacation in Asia and feel they are entitled to fish in their own pond. They play a game of rationalization assuming they are smarter than everyone else and are shocked when they are fired by a university or a college that apparently was in desperate need of their services. A technical description might be borderline personality disorder or a narcissistic tendency. It's very difficult to reason with such a person. If you want to see how this plays out with teachers who do have valid certificates and actually belong to a professional association, use a Google search and type in BC Teacher Regulation and go to the site. You don't have to be a member of this association to view the disciplinary proceedings. Access Professional Conduct and look into the present cases and the archives: it's all there, names, case details,& verdicts for public viewing.It is amazing how many ways there are for a teacher to lose his or her license. A license is formal authorization by law to perform some service; it is not excessive, undisciplined freedom. Individuals on "holiday" in China may want to think ahead to admission to grad school later where they will need references and character witnesses. I hope universities and language schools would not cover up deviant behavior like the man in the article above. The 25 year old fellow who was fired from our staff maintained a very smooth, charming social mask but the repairmen spent almost 2 weeks fixing the holes punched in doors, broken tiles and smashed toilet from the fights between him and his Chinese girlfriend in the school's apartment. Violence and egotism are frequent companions.

This guy is sick, look even at his eyes it shows he is mentally unfit, upon all the numerious women in america and china who are adults and ready for a man, he chooses children. This is madness in the highest order. They should have made him face the jail sentence in china to see how he will last. When some foreigners do this ,it gives the chinese the opportunity to say lots of bad things about us. Animals dont do it to little ones , how come humans who are supposed to know better. A disgrace to the human race.

Such acts give bona fide teachers a bad name. It's good that he was caught. Teachers and students share a very special bond in education, where the teacher is suppose to be respectable and upright. Teachers have a duty of care to ensure that students under their care are not threatened or harmed.
