Guangdong Man Caught with Prostitute Successfully Sues Police for Sending him to Labor Camp

A Guangdong man who was caught red-handed with a prostitute and who was sentenced to six months of re-education through labor after 15 days in detention, sued police authorities for subjecting him to an overly heavy sentence. Remarkably, the man won his appeal after his second attempt at suing the public security bureau.

On December 10, 2011 at around 1:30, 23-year old Pan Liang was caught by police leaving a motel after paying a woman 50 RMB for sexual services. Yuexiu District police immediately took him away and detained him for 15 days. After the 15 days, he was sent to a labor camp for six months.

Pan Liang thought that his punishment was too severe and brought the public security organ to court, arguing that his combined detention and re-education through labor sentence was a violation of the Administrative Punishment Law of China. However the court believed that re-education is a compulsory measure and ruled in favor of the public security bureau.

As a result, Pan Liang took his case to the Guangzhou Intermediate People's Court arguing that he had only committed a “vice” once. This time the court took his side, stating that there was an insufficient basis to send him to re-education camp. The court also ruled that the Public Security Bureau pay him 22,000 RMB in compensation.

How did they KNOW she was a prostitute. How did they KNOW what he had paid her? How did they KNOW he had had sex? A prostitute is a person like anyone else. what if the man was her boyfriend? Is she the ONLY prostitute in town? Is HE the ONLY customer?

This may be a bit of naivety on my part, but since my first time in China, I have never seen a Chinese police officer with a gun. When I visited Beijing I did and once in Shanghai airport when they were bringing money in from an armored car, but I never saw local police officers carry them.
